Sub: Charter of Demands – NJCA decision for Indefinite Strike from 11th July, 2016 – reg.
The report of events since the date of Strike Notice served on GMs etc on 9th June, 2016 is given below briefly:-
(A) The affiliates have conducted strike campaign very seriously and reached as many establishments as possible during the campaign.

(B) Massive demonstration was held on 24th June, 2016 in front of the Parliament wherein over 70 thousand Central Government Employees including railway employees have participated in support of Strike action.

(C) On 27th June 2016, a meeting was hled between the full Board and both the Federation (NFIR & AIRF) on railway specific issues. The discussions were cordial although there was no decision in view of the fact that general demands relating 7th CPC were yet to be finalized at the point of time.

(D) On the Government’s acceptance of the recommendations of 7th CPC report the protest actions besides strike preparations have been intensified from 30th June 2016 onwards.

(E) The General Secretary/NFIR met Shri Suresh Prabhu, Railway Minister on 30th June 2016 at 15/30 hrs and explained the need to settle the issues satisfactorily to avoid atmosphere of confrontation. He requested the Railway Minister to approach the Prime Minister for intervention in resolving major issues common to all central government employees. The Railway Minister took immediate initiative, consequently a message was received from CRB on 30-06-2016 at about 18/45 hrs to meet Union Ministers.
(F) On 30th June 2016, at the invitation of the Government, NJCA Chairman Dr.M.Raghavaiah, convenor Shri Shiva Gopal Mishra, besides Shri KKN Kutty and Shri Sri Kumar met Central Ministers S/Shri Arun Jaitley, Finance Minister, Rajnath Singh, Union Home Minister, Suresh Prabhu, Railway Minister and Manoj Sinha, Minister of State for Railways at the residence of the Union Home Minister at 21/30 hrs.
Discussions were held for over 1 1/2 hours on main demands – Revision of minimum wage and multiplier factor. After discussions, it was agreed to refer these two issues to the committee to examine and give its report for further action.

(G) The NJCA met on 1st July, 2016 at New Delhi and has taken stock of the developments. After discussions, it was decided to meet on 6th July, 2016 for taking appropriate decision.

(H) It is also conveyed that the General Secretaries of both the Federations met Railway Board, chairman on 4th july, 2016 (evening) The CRB has assured that the issues raised by the Federations will be dealt with positive mind for finalizing satisfactorily and a special meeting will be held to discuss the issues.

(I) The Railway Board have fixed a meeting between full Board and Federation’s to be held on 21-07-2016 at 11.00 hrs., to discuss Railway specifie issues for reaching satisfactory conclusions, The General Secretaries have agreed to participate in the meeting.

(J) The NJCA met at New Delhi, this date (6th July, 2016) and discussed in detail the developments taken place during the past one week including the discussions held with the central Ministers on 30th June 2016. During discussions, invitation was received from Hon’ble Home Minister Shri Rajnath Singh to meet him for discussion. The NJCA leaders reached his residence and explained on the issues wherein Hon’ble Finance Minister has agreed on 30-06-2016 to refer the issues (Minimum Wage, Multiplier factor) etc., to a Committee. The NJCA leaders have urged upon the Hon’ble Home Minister to see that Finance Minister issues statement accordingly to facilitate the NJCA to consider for deferring the strik. The Hon’ble Home Minister has agreed to get this done.

PRESS STATEMENT
The National Joint Council of Action (NJCA) met at the staff side office,JCM New Delhi today at 11.30 AM as scheduled. During the discussions, the covener received an invitation from the Honourable Home Minister, Shri rajnath Singh. The following members of the NJCA met the Home Minister in a delegation.

The issues in the charter of demands were discussed with special reference to the 7th CPC related demands. The delegation brought to the notice of the Honourable Home Minister that the NJCA has not received a communication from the Government over the assurances held out on 30th June 2016 when the NJCA delegation met the Honourable home minister, Finance Minister and the Railway Ministers. On 30th June 2016 the Government had assured to refer the revision of Minimum wage and fitment formula to a committee. The Finance Minister had also clarified that the Government has taken the decision to implement the recommendation of the 7th CPC to bring about parity between the past and present pensioners. They added that such a communication in confirmation of the assurances will enable them to take a decision over the strike action which is to commence from 11th July 2016.
The Honourable Home Minister assured the delegation that the Government will honour the assurances held out to the NJCA leaders on 30th June, 2016 and accordingly the Honourable Finance Minister, Shri Arun Jaitely will issue a Press Statement today, with copy to NJCA.
Accordingly, The NJCA has received the press communique issued by the Honourable finance Minister today, the committee set up to look into the matter of minimum wage and fitment formula is expected to submit their report to the Government in the given time frame of not more than four months, In view of these developments the indefinite strike call which is to commence from 11th July, 2016 is deferred till the committee finalises its report.

Government assures Representatives of Unions representing employees of the Central Government that the issues raised by them relating to the pay scales and other recommendations of the 7th Pay Commission would be considered by a High Level Committee
Representatives of Unions representing employees of the Central Government had met the Home Minister Shri Rajnath Singh, the Finance Minister Shri Arun Jaitley and the Minister for Railways Sh. Suresh Prabhu in the evening of 30th June, 2016.
They had requested that certain issues raised by them in relation to the pay scales and other recommendations of the Pay Commission be allowed to be raised before a Committee of Secretaries looking into different aspects of grievances of employees in relation to the Pay Commission recommendations.
The Ministers assured the Union leaders that the issues raised by them would be considered by a High Level Committee.

Dear Sir,
Sub: Charter of Demands, Mainly Minimum wage, multiplier factor, railway specific issues etc. Serious resentment among railway employees against the Government’s decisions – reg.
the presidents and the General secretaries of Federations (AIRF & NFIR) called on you yesterday i.e. 29th June 2016 and conveyed our serious disappointment as well unhappiness among railway employees on the Government’s decisions relating to VIIth Central Pay Commission’s Recommendations.
We are extremely sad to convey that the Government has not reasonably dealt with our demands mainly minimum wage, multiplier factor, abolition of National Pension System in Railways etc. The railways specific issues mentioned in Part ‘B’ of charter of demands have also not been settled through discussions.
We have also conveyed to you that the industrial peact is being threatened in railways on account of Government’s unreasonable and illogical decisions. During discussions, we have specially requested to kindly reach Hon’ble Prime Minister for conveying the total disappointment among all categories of railway employees and for finding ways and means to resolve matters to avert untoward developments in Railways. Here it is worth-mentioning tht on previous occasion too during the course of discussions, we had requested for out meeting with Hon’ble Prime Minister of India.
We therefore request you to kindly approach the Hon’ble Prime Minister for solving the issues amicably as we are keen to preserve healthy industrial relations in railways. We trust that the railway specific issues will be resolved through negotiations under your leadership without further delay.

GOVERNMENT’S DECISIONS ON 7TH CENTRAL PAY COMMISSION’S REPORT
29-JUNE 2016
(A) The 6th CPC Pay Band, Grade pay system has been dispensed with and a new pay matrix as recommended by 7th CPC has been approved.
The status of the employee, hitherto to determined by Grade Pay, will now be determined by the level in the pay Matrix.
(b) The minimum pay has been revised from Rs.7000/- (Rs.5200 pay in PB-1 + GP 1800) to Rs.18000/- p.m. whereas freshlly recruited class I officer will receive pay @ Rs.56100/- p.m this reflects a comparison ratio of 1:3:12.
(c) For the purpose of revision of pay and pension a fitment factor of 2.57 will be applied.
(d) Rate of increment has been retained at 3%. This will benefit the employees on account of higher basic pay due to 2.57 multiplier factor.
(e) Gratuity ceiling enhanced from Rs.10 lakh to 20 lakh. The ceiling on gratuity will increase by 25% whenever DA rises to 50%.
(f) The ex-gratia lumpsum compensation to the next kin of those killed in the course of performing duties – the existing rates enhanced from Rs.10 lakh to Rs.20 lakh.
(g) Hospital Leave, Special Disability and Sick Leave subsumed into composite new leave named “Work Related Illness and Injury Leave”(WEIIL). Full pay and allowances granted to all employees during the entire period of hospitalization on account of WRIIL.
(h) The ceiling of House Building Advance has been enhanced from Rs.7.50 lakh to Rs.25 lakh.
(i) four interest free advances namely for medical treatement. T.A. on tour/transfer, T.A. for families of deceased employees and LTC have been retained. All other interest free advances have been abolished.
(j) Monthly contribution towards Central Government Employees Group Insurance Scheme (CGEGIS) will continue unchanged. However, the cabinet has asked the Ministry of Finance to work out a customized Group Insurance Scheme for Central Government Employees with low premium and high risk cover.
(k) The general recommendations of the 7th CPC on pension and related benefits have been approved. Both the options recommended by the pay commission as regards pension revision have been accepted subject to feasibility of implementation. REvision of pension using second option based on fitment factor of 2.57 shall be impelmented immediately. A committee will be consituted to address the implementation issues anticipated in the first formula.
(l) The Government decided to constitute a committee headed by the finance secretary to further examine the recommendations of 7th CPC on allowances. The committee to submit its report within 4 months.
(m) Cabinet also decided to constiture two separate committees – (1) To suggest measures for streamlining National Pension System (NPS) and (2) Look into the anomalies likely to arise out of implementation of the commission’s report.
(n) It was decided that the concerned ministries may examine the issues that are administrative in nature, individual post/cadre specific and the issues in which the commission has not been able to arrive at a consensus.
(o) Financial implications have been estimated by the 7th CPC at R.102100/- crores.

The Committee of Secretaries studied the report for six months and the outcome was NIL.The High Level Committee now proposed is another ruse and delay the matter and the outcome is going to be no different from any so far.If,according to NJAC ,the GOI has agreed to its demands why cant these be settled across the table instead of dilly dallying.The HLC is a delaying tactics and NJAC should not have accepted this and insisted on GOI accepting the NJAC demands to the maximum extent possible.The HLC is a devious method of Govt to drag and deny the legiti.mate demands and ultimately take the employees and pensioners for a merry go around resulting in no benefit at all.

Sir, I am a central Govt employees joined service after in 2006. My biggest concern is over the NPS which is a obstruction to our family’s security. I have only 5-6 lakh in NPS account so far. But how come my family be survive with this amount if something happens to me now. There are other employees who have also the same fear. Sir please do every possible step to retain back the old pension system. This time we are united together so this is the right time to stand before Govt. Abhi him log issue nehi sakega to kabhi nehi.. Please Sir.

.As the strike defers till the high level committee submits the report the revised pay should not be implemented. If it is implemented the govt will not sanction the revised pay
